Attorneys for the town have asked that the Norfolk County Superior Court rule on a dispute with previous town administrator Kevin Mearn rather than push the case to a jury trial. The request for summary judgment was made in early October, but a hearing on the matter will most likely not be held for several weeks, said John Flynn, an attorney with Murphy, Hesse, Toomey, & Lehane. Mearn initially filed a complaint against the town in December. Mearn’s contract was not renewed by selectmen in July and he was let go by the town in August. Mearn said he is owed approximately $132,000 per the severance terms of his contract. Town attorneys claim that Mearn was working as an at-will employee once his contract expired, and claim the town doesn’t owe him anything.
