A New York City judge says news anchor Dan Rather can proceed with his $70 million lawsuit accusing CBS of violating its contract with him when the network fired him. Judicial Hearing Officer Ira Gammerman dismissed a fraud complaint against CBS Corp. yesterday and a business interference complaint against CBS and former parent company Viacom Inc. (AP)

Emmys rate a disaster

Dunne stricken

Celebrity crime writer Dominick Dunne was taken to a Las Vegas hospital yesterday after he said he was stricken by pain while watching testimony in O.J. Simpson's armed robbery and kidnapping trial. Cyrus rumors ripped

Miley Cyrus and Disney Channel sought to shoot down rumors yesterday that the teen star of the TV hit "Hannah Montana" was seeking to part ways with the show. Patti McTeague, a Disney spokeswoman, said reports of on-set turmoil were "absolutely not true, pure gossip." (Reuters)

Rock Hall nominees

Run-DMC, Metallica, and Bobby Womack are among nine nominees announced yesterday vying for five spots in the Rock and Roll Hall of Fame. Guitarist Jeff Beck, disco band Chic, singer Wanda Jackson, doo-wop group Little Anthony and the Imperials, the Stooges, and War were also nominated. The inductees will be announced in January.
