Reese Witherspoon says she 'had one drink too many,' apologizes for Friday arrest

America's sweetheart Reese Witherspoon and husband Jim Toth, an agent for Creative Artists Agency, were taken into custody early Friday morning in Atlanta. Toth was pulled over at a traffic stop for swerving between lanes and subsequently jailed with DUI charges after failing a sobriety test, according to the official report acquired by Variety.

The "Mud" actress was also cuffed and taken into custody after she "verbally sparred" the arresting officer. The couple was quickly released on bond at 3:30 a.m. on Friday.

Witherspoon released a statement Sunday, according to E! Online, saying:

"Out of respect for the ongoing legal situation, I cannot comment on everything that is being reported right now. But I do want to say, I clearly had one drink too many and I am deeply embarrassed about the things I said. It was definitely a scary situation and I was frightened for my husband, but that is no excuse."

The Oscar-winning actress also apologized for being "disrespectful" to the arresting officer and said she has "nothing but respect for the police."

Witherspoon and Toth were due in Atlanta Municipal Court for a hearing on the incident earlier this morning but neither was required to attend. E! notes the maximum charge for Toth could be "a year in jail, a $1,000 fine, 40 hours of community service, a defensive driving class and a license suspension," while Witherspoon could face "a $1,000 fine and up to 60 days in custody" under city ordinance. A follow-up court date may be set within the next 30-60 days depending on today's outcome.

Witherspoon and Toth both attended the Sunday premiere of her upcoming film "Mud" in New York City, but opted to keep mum on the topic.
