Cambridge-based Zipcar Inc. said yesterday that it is satisfied with the dismissal of a potential class-action lawsuit that claimed five penalty fees charged by the car rental company are illegal.
According to a posting yesterday on a Massachusetts Lawyers Weekly blog, a former Zipcar customer filed the suit, citing Zipcar’s $50 late-return fee and others.
US District Judge Nathaniel M. Gorton found that every penalty except an inactive-user charge is legal. But since the plaintiff had not proven that he had paid that fee, he had no standing to bring a case about it.
Zipcar’s general counsel, Maria Stahl, in a statement said the fees “are reasonable and necessary.’’![]()
