Greg & Pinkie: You just don't understand how general intent and specific intent within the law works. There's nothing wrong with that. It's just pretty ridiculous to watch you two trying to lecture people who know what they're talking about on how silly hate crime laws are.....when you don't even understand how intent works in criminal law. /shrug

I'm quite aware of what intent is.

I intend on beating the sh!t out of you because I'm an angry a55hole and I didn't like that you bumped into me. I beat the sh!t out of you and get arrested.

I intend on beating the sh!t out of you because I'm an angry a55hole and I don't like homosexuals. I beat the sh!t out of you and get arrested.

In my opinion, all scenarios deserve to get arrested and punished. I don't see why there needs to be a difference in punishment. Are you saying the homosexual is worth more since his guy gets punished more severely?

For anyone who is interested in attending, there will be a regional prayer service for the Sikh community and those killed..tomorrow night ( August 23) at Trinity Episcopal Church on Clarendon St. in Boston. Anyone is welcome to come and pray in solidarity and learn about Sikh faith and traditions, hear typical music played during services, etc. The prayer service will be followed by a communal meal.

Assault with intent to rape or murder is much different. That would be multiple crimes occurring. Versus just one. Much different.

Assault with intent to assault you because you're gay or wearing a Yankees hat is not the same as the previous mentioned. Sorry...it's apples and oranges.

No, he said the rape was intended. It never had a chance to happen so was never a crime. Yet he gets punished more severely than a "standard" assault. So in effect, he is getting punished for the INTENT, as well as the CRIME.

Maybe and maybe not.  There is still a crime for assault with intent to rape.  That is different in terms of punishment than simple assault.  And yes, the victim makes a difference.  You are punished more severely if you assault a cop, a child, an elderly person...  And those are issues of simple fact as opposed to intent. Hate crimes are all about the intent, an intent that is not confined to the actual subject of the assault, but a whole class of people.  That's why they get zapped harder: the impact on society is greater.

Ever notice how liberals never flip out and kill white supremists.

Its hard to admit that I probably wouldn't be all that upset if they did, but trying to left/right this is absurd.

I'm pretty sure those THOUSANDS of people who burned LA to the ground in Watts and after the Rodney King verdict, or Harlem in 77 or the Kill the Jew crowd in NYC that followed through (and led by Al Sharpton), weren't terribly conservative.

Oswald was so far left, his sun rose in the West.

Sirhan Sirhan, the crazy Israel hater, uhm, hardly a righty.

I'll give ya Hinkley.  He was just fr1ggin nuts.  But I think I can say without fear on infamy that Squeaky was just a tad left handed.

Leon Czolgosz and Chucky J. Guiteau, were heavy southpaws.

Point being, that the political leanings of cupcakes are irrelevant.  Its the cupcake thing that matters

I can only imagine that even more ridiculous than thinking I'm lecturing anyone, is the belief that I don't acknowledge hate crime.
