Cambridge councilor will not face drunken driving charge

A Boston Municipal Court clerk magistrate ruled today that there is not enough evidence to charge Cambridge city councilor Anthony Gallluccio with drunken driving in connection with a December accident in downtown Boston.

A witness and two people involved in the Dec. 18 crash testified that they believed Galluccio was inebriated. A report from an emergency medical technician also said it appeared the councilor was impaired. But two Boston police officers said they did not detect alcohol on his breath.

Boston police have acknowledged that the responding officer did not immediately test Galluccio to see if he was legally intoxicated, and a supplemental police report suggests that a follow-up investigation did not begin until Feb. 13, after the department received a letter complaining that he was getting preferential treatment.

Galluccio didn't testify in the hearing today and declined comment afterwards. He has said he accepts responsibility for the wreck and has already paid a fine.

One of his lawyers said the ruling should put the matter to rest.
