Officer files civil rights suit vs. city, chief
A police officer who was cleared and reinstated after he was fired for allegedly driving drunk has filed a civil rights lawsuit against the city and Chief Robert Crowley. The suit filed Friday in federal court by Timothy Kaes seeks unspecified monetary damages. The suit accuses Crowley of maliciously ordering a criminal proceeding against Kaes without probable cause, and alleges that his rights were violated when his vehicle was searched. Kaes's sport utility vehicle hit a hydrant, a sign, and another car before slamming into the garage of a home on Sept. 27, 2005. Kaes said he crashed trying to avoid hitting a coyote in the road. An arbitrator found there was virtually no evidence that Kaes was drunk when he crashed, and that there had been no grounds to fire or even discipline him.
