Man denies beating girlfriend, attacking her dog

October 27, 2008 03:03 PM

By John R. Ellement, Globe Staff

Addendum: Five of the six charges in this case were dismissed in April 2009
for lack of prosecution, including the allegations of assault and battery, larceny, and
cruelty to animals. DelPozo did plead guilty to one charge, resisting
arrest, and received a suspended sentence.

A man pleaded not guilty today to charges that he attacked his girlfriend this weekend in a jealous rage and threw her palm-sized chihuahua against a wall, breaking one of its paws.

Miguel Roberto Delpozo Castillo, 26, shook his head in disagreement in Boston Municipal Court as a prosecutor alleged that he trashed the Joy Street apartment on Beacon Hill where the couple lived, then turned on her dog.

Castillo allegedly threw the chihuahua at the wall, leaving it bloody and covered in feces, because it was so scared it lost control of its bowels, said Suffolk Assistant District Attorney Vincent DeMore.

Castillo’s attorney, Anne Rousseve, said that her client categorically denies attacking his girlfriend or her dog.

“The allegations are extreme but they remain allegations only," Rousseve said. "We very much look forward to trial in this case.”

Castillo is an Ecuadoran national who has been in the United States under a student visa for at least six years, Rousseve said. He went to high school in Arkansas and attended the University of Massachusetts at Boston for three years.

Rousseve said her client recently transferred to Harvard University where she said he is a senior and active on campus.

A university spokeswoman said today that there is no student at Harvard College or its Arts and Sciences school with Castillo’s name.

However, a man with the name of Roberto Delpozo and the same date of birth listed for Castillo in police report is a student at Harvard University's Extension school, a spokeswoman for that institution said. Delpozo is currently a full-time student for the fall semester and was also a full-time student this spring. He has attended classes since 2007 but is not in a degree-granting program, the extension spokeswoman said.

According to a Boston police report filed in court, Castillo was jealous because he suspected his girlfriend of dating another man. He allegedly slapped her and punched her, then grabbed the dog and threw it at a wall, according to the report.

“The dog was obviously involved in some kind of traumatic event, which caused it [to] be hurt," police wrote in the report. "It was shaking and attempted to walk over to [an officer,] but it was more of crawl with it dragging one leg and continuously falling."

Judge Robert McKenna set bail at $1,000 cash.

  1. Why the dog? Did it cheat? That guy should put a leash on the other dog and then throw himself against the wall

  1. WHAT AN ASS WIPE...I HOPE HE GETS DEPORTED. HERE ON A STUDENT VISA, SUPPOSEDLY GOING TO HARVARD...WHATS SAD IS THAT I KNOW NATURALLY BORN CITIZENS THAT WOULD LIKE TO GO TO HARVARD THAT CAN'T BECAUSE THE GOVERNMENT FAVORS IMMIGRANTS OVER THEIR OWN. I AM SO FED UP WITH THIS SYSTEM, THIS IS THE SAME SYSTEM THAT HAS GOTTEN US INTO THE MESS THAT WE ARE IN TODAY. DON'T WORRY THE TAX PAYERS WILL BE THERE TO SUPPLY A FAIR TRIAL TO THIS SCUM BAG. I HOPE HE FINDS A NICE BOYFRIEND WHILE HES IN JAIL.

  1. If an American Citizen were accused of the same crime, he would be tarred and feathered - but these Latin Aliens seem to somehow walk-on-water when it comes to abusing women and other crimes against humanity. For shame Massachusetts...

  1. If he didn't do it, then who did? I'd like to hear his side of the story. I am sure it is a pathetic version.

  1. Good thing he doesn't know me...if someone hurt my dog that would be the LAST time- he would definitely regret it if he messed with my dog!

  1. Great comments. The guy happens to be from another country and you leave comments about student visa expirations...and tilly's FBI knowledge knows that this guy has alias' too...and Latin Aliens reference was real nice too. You read an article and all of a sudden the stereotypes and insults start flying for no reason..except true ignorance. If he's guilty of this crime he will be punished...as he should be. But no need for all the racism just because this idiot happens to be Latino.

  1. How very sad this has happened. A child has lost his life. A parent has to live with a decision he has made and all you fools can do is criticize him. You have hate in you. an accident has happened. It doesn't matter how. Show some compassion for this family.

My heart goes out to the family...God bless all of them at this terrible time!!!

  1. THIS IS DISGUSTING. I always believe the punishment should fit the crime so if this sick individual did this he too should be thrown against a wall by a man 5 times his size. Fair is fair. This is disturbing and he should rot in hell for it. Poor dog. If anyone ever touched my dog it would be the last thing they did.

  1. The requirments for student Visa's need to be more strict for everyone. This guy is in a program that does not offer a degree and is 26 years old. Most students graduate when they are 22-23 years of age. Isn't it convenient that he can stay in school & live in the United States & beat up a female college student & her defenseless puppy. This guy needs to GO HOME.

  1. revoke his visa and send him back now.

Posted by kelly October 27, 08 07:06 PM
  1. agree with kelly.. if found guilty.. deport this macho abusive creep back to where he came from.. our jail system is overcrowded, our state's budgets are in the red.. why should we support another sick low life who just may end up killing someone.. or someone's pet, down the road??

  1. some shitty thing happens... and of course all you can think of is "oh the guy was latin" ...what the hell, how predictable, how ignorant, and how american...
same punishment for all sorry... the fact that he was from ecuador or whatever had nothing to do with it, american, chinese, latin, he would be a creep if he actually did it. get it? stop the racism people!!! ten years from now the latin community will become a majority in most of your states... and you still cant deal with it ...you'd seriously all be indians if the europeans hadnt come here to settle in the first place... be tolerant, maybe then the rest of the world will learn to like this country a bit more.

  1. Wow a thousand dollars bail? He got off easy man. He chucked a dog.

Posted by AJ October 28, 08 12:34 AM
  1. Right on #7, Reader. Guy is an obvious sociopath , race and citizenship are irrelevant. We all know lots of white american citizens are abusers, so race shouldn't come into the picture-speaks to ignorance. The real issue is the crime -the guy should be punished severely for injuring an innocent 4 pound dog.

Posted by sophiemae October 28, 08 06:12 AM
  1. I CAN NOT BELIEVE THE IGNORANCE . THE MAIN FOCUS IMMEDIATELY BECOMES THAT HE IS A LATIN IMMIGRANT. IF HE WOULD HAVE BEEN AMERICAN WOULD IT HAVE BEEN LESS OF A CRIME? AMERICANS ALSO COMMIT THESE CRIMES. THIS MAN IS A DOUCHE NO MATTER WHERE HE CAME FROM. STOP THE HATE. HE WILL BE PUNISHED TO THE FULL EXTENT OF THE LAW.

    Posted by C October 28, 08 11:41 AM
  1. Pathetic. Not his actions but your reactions! I don't know what's worse the fact that this guy did what he did, or that there are still sooo many Americans with your mentality. First point, if you are not a Native American, then you are an immigrant, period. Second point, ignorance is the first door you have to open to fail in life. How about those of you who want immigrants (latinos) out of this country do some research on the consequences of not having latinos in the U.S. Many of you would say, "oh more jobs", "oh less crime". But no, you are wrong. Latinos do the job you feel you don't want to do, and they do it with pride. Latinos are trying ot make of this country the best place to live, and the fact that this guy is latino doesn't have to with anything. Crimes happen amongst everyone, and being latino doesn't make you more prone to commiting crimes. I just want to see your faces when latinos become the majority, when instead of having a black candidate for president you have a latino. I just want to see what you ignorants are going to do. Maybe you'll say "we always loved latinos, now lower our taxes please". Become educated, respect others, and lern that tolerance is the key to success.

  1. I have traveled to several Spanish countries and it was horrible in what I saw in the ways they treat animals. They beat them and starve them or make bets in who will run over a dog. I cried when I saw this man in El Salvador beating his cow she was full of blood and people just kept on walking and ignoring in what was going on and me being an American was scared for life. And there are no laws in defending the animals so they get killed everyday. So this gentleman should be deported right away back to his country. He will regret this for the rest of his life.
