Facing sex charges, Marzilli represents Mass. Senate in Germany

Democratic state Senator J. James Marzilli, who has been accused of sexual assault, flew to Germany last month and participated in a panel discussion on “Greening the Economy” that identified him as a representative of the Massachusetts State Senate.

The international conference, which took place in Berlin on Oct. 8-9, was sponsored by the Heinrich-Böll-Stiftung and the Institute for Ecological Economy Research.

Marzilli pleaded not guilty in June to charges he accosted four women in Lowell. Marzilli did not seek reelection but continues to be paid and will receive a bump in his pension if he remains in office until January.

Marzilli's attorney, Terrence Kennedy, defended his client's trip to Germany, saying this afternoon there was "absolutely no prohibition to him traveling anywhere but Lowell.”

"He didn’t use any taxpayer funds while he was there," Kennedy said, adding that Marzilli has attended the conference numerous times in the past. "He didn’t violate any law, he didn’t violate any rule. There was absolutely nothing wrong with it.”

While Kennedy asserted no taxpayer funds were used, if Marzilli got the same deal as another attendee, he did not have to pay out of his own pocket.

Anja Caldwell, an environmental architect from Maryland who was on the panel with Marzilli, said she did not get a speaking fee, but conference organizers paid for her airfare and hotel. She was contacted about three months before the conference.

Marzilli's quiet trip to Germany preceded the arrest of state Senator Dianne Wilkerson, a Roxbury Democrat who is accused of taking bribes to shepherd through legislation in an FBI sting. The Senate took swift action, calling unanimously for Wilkerson to resign, but so far has not taken similar action on Marzilli.

“Jim Marzilli has a diagnosed mental illness, this is a different situation,” Senate President Therese Murray said on Oct. 28, the day that Wilkerson was charged by the FBI. “This is selling your public office.”

In a statement issued this afternoon, Murray said: "I find it completely outrageous given the circumstances of Jim Marzilli's pending Senate ethics investigation and criminal trial that he would use his elected status in this way, and I expect this information to be taken into consideration by the Senate Ethics Committee currently reviewing the question of his conduct."

The Senate called for an ethics investigation for Marzilli -- as it has for Wilkerson -- but the results have not been made public. Wilkerson has announced intentions to resign, but so far has not.

The state Republican Party has called on Marzilli to resign, but the Senate has not taken any action. The GOP has kept a running tally of the state tax dollars that have gone to Marzilli since he was indicted, which has come to $24,313.50.

“Jim Marzilli should resign or be expelled from the Senate today,” said Barney Keller, a spokesman for the Republican Party. “Not tomorrow, or a week from now, but today. The taxpayers have already paid him nearly $25,000 since his indictment, and it is an absolute farce if he gets paid one penny more.”

Marzilli, an Arlington Democrat who served for 17 years in the House before being elected to the Senate in a special election last year, was up for reelection this fall. He dropped out of the race this summer, but did not resign.

  1. Unbelievable. He is accused of sexually assaulting, not one, but FOUR women, and he still has his job, still gets paid, and now takes trips to Germany on taxpayers expense. Do not need an ethics investigation on this one, should have been clear - he should NOT have been representing this state at that conference, or at any other's for that matter. What is going on here? Who approved that trip and expense?

Leave it to Senate President Therese Murray to whitewash sending a sexual preditor, as an emmissary of the Commonwealth of Massachusetts to Berlin by saying, it's OK, he's been diagnosed with a mental illness that makes him a sexual preditor. Look out Deval, we may be getting another unexpected bill you'll have to pay. He's on our dime. Any damage he does will be our responsibility.

  1. i want to know why his staff did not report this to the press. If he is using his title of Senator, then he is on official business. Obviously the taxpaers should not be paying for someone that can fuction in Europe in offical capacity but not on Beacon Hill. Much like sarah Palin, Jim;s staff made a huge error hiding this trip. Is Marzilli directing his staff on issue or are they the default senator, except for voting?

    The House has REFUSED to convene an ethics investigation of Speaker Sal DiMasi.

    If ever there is a smoking gun for both state Attorney General Martha Coakley and U.S. Attorney Michael Sullivan to conduct separate investigations of Speaker DiMasi, it's the arrogance of the House Ethics Committee refusing to investigate its own speaker.

I used to think that we deserve what we get when we keep voting these people in - now I really wonder if the votes are counted - does anyone else notice how the election results were in so fast this time? I refuse to believe that the people of Massachusetts actually voted down question 1, voted yes on question 2 and voted no on question 3 - all three in my opinion, against our own self-interests.

  1. It's unfortunate that Sen. Murray is perpetuating misinformation about mental illness. It's been widely reported that Marzilli has bipolar disorder - altho somehow I doubt that Murray has access to his psychiatric diagnosis - which she apparently believes is a reason/excuse for his (alleged) sexual assaults. But where in the world is she coming up with a connection between between the two? We're talking apples and oranges here, folks. Would she say the same thing about a more widely-understood condition, like depression or diabetes? I hope not.

  1. ya know, as a reasonably enlightened citizen and all you'd like to see beyond the details to the big picture, to see the logic in things, to give the benefit of a doubt etc. marzilli did a good job by most accounts, good guy, intelligent, well spoken. but how is it possible there was no one else as qualified that could be sent to germany? it doesn't make sense.

    from someone who tries hard to see deeper into things this is just ridiculous. yes, marzilli's problem is different, he's not a crook, just mentally ill and sexually dangerous. hhmm, let's see, who should we send? a crime is a crime, it's arguable even worse to send this guy than wilkerson. i wonder how the germans will feel when they find out? we need some fresh thinking up on the hill.....

Demeaning to say the least. my GOD! Why don't they just say they are addicted to SEX and get it over with? Bipolar disorder is an illness and it can be maintained with medication, life altering situations, therapy, change.Those people that do know of this Marzilli's incidents and still want him in office are just as bad as he is. he needs to resign.
