Same-sex marriages to begin Wednesday in Conn.
By Globe Staff
A new chapter in Connecticut history -- and the history of gay rights -- is about to begin. A Superior Court judge in New Haven is expected to enter the final judgment in a case authorizing same-sex marriage in that state. And once that happens, same-sex couples are free to get marriage licenses.
The Connecticut Supreme Court ruled 4-3 last month that same-sex couples have the right to wed. The high court sent the case back to the Superior Court, where Judge Jonathan Silbert is slated to issue his ruling Wednesday.
Connecticut will join Massachusetts in allowing gay marriages. (Gay marriage was also legal in California, but it was outlawed by a statewide vote in last week’s elections.)
Gay rights advocates have said they expect it to be a historic and happy day. Some same-sex couples said they were elated.
"We're thrilled and we don't want to wait one minute," said Peg Oliveira, a 36-year-old yoga teacher and educational consultant who plans to marry Jennifer Vickery, a 44-year-old lawyer, on the New Haven green on Wednesday. "I want to show the folks who worked so hard to make this possible that we are very grateful and we don't want to wait any longer to be able to say the words 'We are married."'
But Peter Wolfgang of the Family Institute of Connecticut said the people of Connecticut never got a say in the decision.
“The same-sex marriages that will begin tomorrow have no democratic legitimacy whatsoever,” he said this evening. “They rest on a judicial coup d’etat. Four unelected judges have imposed this on us.”
Gay rights activists argued before the Supreme Court that the civil unions previously authorized in Connecticut were a separate and inherently unequal institution for gays and lesbians.
In his majority opinion, Justice Richard N. Palmer agreed with the activists. He wrote that the "segregation of heterosexual and homosexual couples into separate institutions constitutes a cognizable harm," in light of "the history of pernicious discrimination faced by gay men and lesbians and because the institution of marriage carries with it a status and significance that the newly created classification of civil unions does not embody."
In a dissenting opinion, Justice Peter T. Zarella wrote that "there is no fundamental right to same sex marriage."
Material from The Associated Press was used in this report.

How about we put heterosexual marriage on the ballot? I think we should outlaw that/
Sounds like you folks need a Prop 8.
Thank heavens we have judges who stop mob rule from harming minorities. "Activist" judges stopped segregation and over turned anti-miscegenation laws. Now they are giving equal marriage rights to all people.
Equal Protection under Law IS the heart of democracy, because it ensures larger groups do not deny freedoms and rights for smaller groups, or for individuals. If rights only belong to the powerful, the numerous, or the well-liked, than huge numbers of Americans would have no rights at all. It is sad that democracy has been ended in large sections of the USA by violating Equal Protection under Law, one of the requirements of democracy. Good for Connecticut residents for upholding the bedrock principle of Equal Protection which sustains democracy and for realizing that government of the people, for the people, and by the people should not perish.
The dissenting Justice was correct. There is no fundamental right to gay marriage. This is judicial fiat. This country is headed in the wrong direction. However, there are far more important issues to address, like the pathetic pay of our military people, such that their families live in a state of near-poverty while they risk their lives for us. This country is going downhill fast.
The whole purpose of marriage in society is the declaration of a new breeding pair. I've never been anti-gayrights before but I don't see them as a hard done to minority this time, I just see them as being unreasonable. Gays shouldn't marry just as boys can't join the girl guides. Stand together, protect the meaning of our ancient institutions, marriage is not a tax break or a ticket to citizenship.
Do this country a favor, Concerned Citizen, and move abroad. The USA is finally showing signs of common sense and unity...and rising once more to the reputation upon which we have been resting our laurels for 8 years now. Your narrow mindedness is tedious. There are FAR MORE IMPORTANT issues to be concerning ourselves with than the lifestyles of military families- I appreciate their service as much as the next citizen, but honestly- the military is a chosen career and comes with pros/cons just like any other job. So, I encourage you to challenge yourself to see beyond the tip of your nose to some big picture issues here- healthcare for average citizens who work and contribute throughout their whole lives, just to get sick & not have adequate insurance coverage, the economy, equal rights and respect for ALL U.S. citizens- black, white, muslim, christian, gay, straight, wealthy, poor- outrageous education costs, energy and global warming, and fostering international relations to name a few. In the grand scheme of things, this country is in bad shape, but for the first time in a while, we have a leader with vision and hope for a better future. Gimme a break, CC...
When will people start to understand that it is not whether or not the right to marry was granted by the legislature, the public or the judges, because those that are opposed to our right to marry will find a reason to find fault with the decision vehicle. It is not a question of WHO created that right, but a fear of the right itself. Hatred and discrimination are taught. At birth, we love everyone and accept all manner of relationships if we can feel the love around us. Fight hatred and discrimination, not loving relationships that want equal opportunity and legal protection and recognition. So simple. So loving. Thanks for listening.
"The whole purpose of marriage in society is the declaration of a new breeding pair. " LOL That will come as a big shock to all the sterile people and old people who get married with NO possibility of "breeding". The simple fact that birth control manufacturers make BILLIONS per year rather shows that marriage is NOT, nor has it ever been about "breeding". No marriage license that I know of requires procreation. It's time the anti-marriage got a new line because this one is just laughable.
As of this moment, gay marriage is performed in a total of two states. 26 states have constitutional amendments prohibiting it and 19 more have statutes prohibiting it. EVERY state that has had a voter referendum on the matter prohibited it. There is a reason for that and for those that don't get it, it has something to do with the fundamental principle of marriage and gays. Nothing more, nothing less.
Gotta love when people throw out that marriage is for breeding couples, give me a break. The last time someone used breeding as a reason to give rights to one group over another was when the Nazis were in power in Germany. You make me sick with that line of logic.
The simple fact is that when the government says groups can be excluded from government sanctioned marriage it is a violation of Civil Rights, period. To deny any one the same government sanctioned privileges is wrong in every sense of the word. It is unamerican, it is unpatriotic and our duty as citizens is to right this wrong.
Judges are the third check in the balance of power in our government. They are the ones who are charged with making sure all rights are ensured to us. They are the ones who are charged with making sure the majority never tramples over the rights of the minority. What pisses me off the most is that if this were an ethnic minority people would be up in arms crying about injustice, yet because you don't feel comfortable with a persons sexual choice it must be wrong. Oh and throw out the whole bible argument because there are more admonishments about hetrosexuals than homosexuals.
Like it or not, This Country was founded on Christian Beliefs! Look carefully throughout our public buildings and the words of our founding fathers and you will see them laced in Christian Beliefs, even giving Praise and Thanks to GOD. Even our money pays tribute to GOD. GOD does have a book given to us with certian laws he expects us to follow and one states 'Thou shalt not lie with mankind, as with womenkind; it is abomination. Need another, If a man also lie with mankind, as he lieth with a women, both of them have committed an abomination. Wait Russia has a history of not having faith in GOD, why not marry there?
The problem with marriage is that it is a religious sacrament. There is supposed to be a separation of church and state in this country that has been seriously blurred over the years. Everyone that becomes "married" , gay or straight, should have a civil union in terms of the law. But, in terms of their particular religion, they are entitled to have a marriage. This will make everyone happy because no one will superior to anyone else in terms of the law. The big problem here is that gay people are being discriminated against in terms of the law because they are not equals when it comes to dividing their assets after divorce, death, etc.
Okay, so if marriage is "the declaration of a new breeding pair" then should a woman or a man who is infertile not be allowed to marry? Oh wait, well she/he and her/his potential mate can adopt... wait... so can gay and lesbian couples... hmm guess you are not really thinking things through, 'Kyle'
KYLE: Why don't you move to Canada! Oh, wait, gays are allowed to marry here. Last time I checked, the sacred sanctity of the sanctimonious (i.e. straight
marriage) was still intact and their divorce rate just as steep as before.
And boys not joining the Girl Guides is stupid. Girls in Canada can now join
Scouts, and all you have to do, Kyle, is DROP THE GIRL and make them guides.
Declaration of a new breeding pair? Bull! That means a childless couple is really a waste of energy??? You are living in a little box. Step outside of it!
Kyle says "The whole purpose of marriage in society is the declaration of a new breeding pair."
I agree. We should start making people pass a fertility test and sign an oath to breed before they can get a marriage license. It's the only way to protect this 'ancient institution.' (Not to be confused with the 'oldest profession.') A strictly administered breeder requirement would weed out all the slackers who can't or don't intend to produce offspring, thus saving tons of precious rice and preventing the deaths of countless innocent pigeons.

So you don't believe that senior citizens should be allowed to get married? Heck, that should mean you don't believe that people should be allowed to get married until they prove that they're fertile together.
This makes me wonder why there was ever a fight for civil unions and same sex benefits if those laws would eventually be viewed by those who fought for them as exclusionary? Or was that the idea to begin with?
What a waste of time and money, among so many other things.
Think all people should have the same rights, a marriage licence is a legal document-and should be available to all-regardless of sex, color, race,etc...
I do think that heterosexual marriage should be questioned if samesex is...perhaps we could put it on the ballot too.
What happened to liberty and jusrice for all, or does that only work when the majority agree .I believe our fore fathers would be proud of conn.I know i am.
It's nice to see that like Massachusetts, people won't get to vote their opinion on this heavily debated issue and that there are self righteous people in our government who will do anything to prevent their own taxpaying citizens from voicing there choice.....NOT!
What a disgrace! The 21st century nuclear family. Why discriminate against polygamists?
To call it a "marriage" is completely out.
Here in Denmark you can go to the mayors office and get registered as a "companionship", which gives you the same legal rigths (inhereritance and so forth) as if you were marriaged.
But this has nothing to do with a marriage .
Only fanatic religious people can figth the rigth to live together.
They must realise that their creator also "made" gays and lesbians.
So please - cancel the word "marriage" from the discussion.
The barriers against "gay" marriage sure do seem to be springing a lot of leaks. My message to the bigots... put your fingers in the dyke. ;)
Mariage no matter how you may view it is a union ,a hetro union to produce children.Just because some gay people want to be normal, they place a different interpretation on the sacred union of marriage .
There is a place for gay union ,Gay people deserve respect ,we are all children of Christ , when the Pope came to Sydney he visited blessed and greeted the gay people and the gay precinct .A gay union is different to a hetro union in purpose, procreation. Love one another be at peace accept your sexuality .Unite in another form,
"The whole purpose of marriage in society is the declaration of a new breeding pair." -- Kyle
I would say the purpose of any marriage is decided by its members. Should the infertile never marry? Unions of mind, body, and spirit are well expressed thru marriage, without reproduction.
Technically, the people of Connecticut had the option to vote on whether or not to amend the state constitution. We voted against it. If we had voted for the Constitutional Convention, gay marriage definitely would have come up, and may still have been allowed even through the legislative process. Why do you care so much about what other people do in their private lives? It doesn't make a difference to you personally. Stay out of other people's lives - there is a fundamental right to privacy and autonomy.
Further proof that they cannot pass a measure like this in a democratic forum (a la ballot measure).
The only way items like this can get passed is by having a liberal judge ram it down people's throats.
How about actually putting it to a public vote to see what the folks on Conn vote on.
Marriage is a civil contract in the US and as such does not require or imply religion. The US was not founded on "Christian" or any other religious principles no matter how much some wish it were so. In 1797 the Treaty of Tripoli states VERY CLEARLY that the US was not founded on the Christian Faith. Why are people so ignorant of our history? The simple fact is, if marriage were left up to religion, there would be no discussion of same sex marriage since some churches marry same sex couples. The problem in this country is more one of stupidity than anything else. No one gets married without state permission. End of story.
If I think society gives more dignity to the label "white" than the label "African American" am I being denied civil rights because they give me a different label? How about "male" and "female?" It's semantics. This is nothing like what we fought for.
who will keep these rogue judges in check? The laws for this country were made for a reason. These laws have been voted on by the majority of the people, but if a small group of people contest the voted law, a judge will overturn it. What about the law that was voted in, does it not matter anymore?
Listen to the Gov. of Ca. He has flopped his story about voted laws in the course of 3 days!!! Where is the accountability for our lawmakers? Lets vote on it.
"Mob rule is what they dub the majority." Enough is NEVER enough with them. They will stop at nothing...and will act up just as they are now when they don't have their way. Enables like the Mayor of San Francisco should be recalled from office. He's an outlaw who gets votes and big contributions on from the entire gay community... as did Diane Fiensteir and Nancy Pelosi. It is a sick world when they are allowed to marry. Tolerance is not enough.
Acceptance is hard when our senses are offended ...so we tolerate. And they want is all now. They will trash your churches and seduce your children... they already have. Now we are the "mob.
