A federal judge is weighing a request to dismiss a $200 fine against one of the creators of a political website that targeted independent Eliot Cutler in the 2010 gubernatorial race. Lawyers for Dennis Bailey asked Judge Nancy Torrensen Friday for a summary judgment, saying the fine imposed by the Maine Commission on Governmental Ethics and Election Practices violated Bailey’s free speech rights. Bailey was an adviser to Democratic candidate Rosa Scarcelli, then joined independent Shawn Moody after Scarcelli lost her primary race. A lawyer for the ethics commission said Bailey’s website did not meet an exemption for news stories because he was working for a candidate. end of story marker
