BARNSTABLE, Mass. (AP) — A Cape Cod judge has found a motorist not guilty in a teenager’s death after a fatal crash on New Year’s Day in 2010.
The Cape Cod Times (http://bit.ly/WCfeLJ ) reports Andrea Mastandrea was acquitted Wednesday of leaving the scene of an accident causing death, and negligent motor vehicle homicide.
The 31-year-old admitted her car hit and killed 17-year-old Andrew Dexter II in Bourne, but said she didn’t know it at the time and left the scene after hearing a ‘‘thud.’’
Dexter had been walking home from a party after drinking.
The Barnstable Superior Court judge said a recent Supreme Judicial Court ruling guided his verdict.
It says a motorist has to know he or she hit someone to be guilty of leaving an accident scene after causing death.
Dexter’s family said there’s been no justice.
