Saugus police said the young boy was riding in the Volvo and his 43-year-old father was driving. The father, a Lynn man, refused medical attention at the scene, and his son was transported to a nearby hospital where he was pronounced dead.

The other driver, 40-year-old Daniel Ortega of Lynn, was treated at and released from a Boston hospital before being placed under arrest for operating without a license. The charge was from an outstanding warrant from 2005 in Danvers. He was also charged with operating without a license on Monday night. He has not been charged with causing the accident.

According to the WBZ-TV report, the scene has since been cleared and investigators are still looking into the crash, including whether the young boy was properly secured. A WHDH report added that police believe the Volvo may have had a mechanical issue.
