Get caught with child porn? If you’re a teacher, you can keep your pension.

The Boston Globe reports that the Supreme Judicial Court ruled today that Ronald T. Garney, 67, is entitled to keep his pension, despite the fact that the former ninth grade teacher at Amherst Regional High School pleaded guilty to purchasing and possessing child pornography in 2007.

A few months before he plead guilty (but after he was arrested), Garney retired. He received benefits until 2009, when the Massachusetts Teachers’ Retirement System decided that he didn’t have to right to receive them. Garney used his work email address to access child porn.

That wasn’t enough of a link for the court. In his decision, Justice Robert J. Cordy wrote that because Garney kept his porn on his personal computer and didn’t have any photos or his own students, “the entirely private nature of his conduct does not call into question the effectiveness of the educational system of the Commonwealth.”

Garney is entitled to receive $2,393 a month. Police found hundreds of images and videos on his home computer, some featuring children as young as 5 or 6.
