Man wanted for murder in Pennsylvania caught upstate

AUBURN, N.Y. -- A man wanted for murder in Pennsylvania was being held behind bars here Thursday.

Jose Cruz, 26, whose address was not available, appeared Wednesday in Cayuga County Court and refused to waive his right to a formal hearing on his extradition.

Cruz was initially apprehended April 6 by Auburn police officer Chris Major, who stopped Cruz because the windows of his car were tinted, Deputy Chief Tom Murphy said.

Cruz identified himself as Frank Mayoral and produced an Ohio driver's license and a Social Security card with that name. Mayoral is a parolee living in New York City, whose height, weight and physical description did not match Cruz, Murphy said.

"We knew he was hiding his identity for a reason," Murphy said. "We just weren't sure what."

Cruz refused to allow his fingerprints to be taken the night he was stopped. He was charged with two misdemeanors, second-degree obstructing governmental administration and third-degree falsely reporting an incident, along with a traffic violation for the tinted windows.

Cruz was arraigned on those charges and ordered held without bail pending a positive identification.

Murphy said police finally identified Cruz on Tuesday through fingerprints sent by authorities in Allentown, where's he wanted on a warrant for a Feb. 2, 2002 homicide in Allentown.
