Authorities defend handover of ventilator

BOSTON—Medical malpractice lawyers and the family of a 15-year-old boy who died when his ventilator failed during a power outage are questioning the wisdom of returning the device to the manufacturer.

Ariel Acevedo, the stepfather of Fernando Vargas, says he's concerned about a possible cover up.

Attorney Michael Mone says the goal should be to preserve the evidence.

Police say Vargas died Friday after his ventilator apparently failed during a power outage. A preliminary investigation indicated the backup battery also failed.

Authorities defended their decision to return the device to Pulmonetic Systems Inc.

Assistant District Attorney Josh Wall says the company has the expertise to find out what happened to the ventilator and will hire an independent videographer to record the work.
