Vermont court says man can sue hospital for blood draw
MONTPELIER -- The Vermont Supreme Court ruled Friday that a man with multiple drunken driving convictions can sue the state's largest hospital for drawing his blood at the request of police. But the court said it is up to the state Legislature to consider whether state law governing when drunken driving evidence can be taken at a hospital needs to be changed to broaden the ability of medical personnel to help the police. Police need to collect evidence, and hospital patients have a right in most cases to give consent before a medical procedure is performed. Vermont closes areas near falcon nests
The Vermont Department of Fish and Wildlife said 10 Ten cliffs and hiking trails across the state are have been closed to protect peregrine falcon nesting areas, state wildlife officials said. Biologist John Buck said peregrine nesting season is well underway and falcons are sensitive to the presence of humans. Buck said the closed areas that are closed include the portions of the cliffs where the birds are nesting and the trails leading to the cliff tops or overlooks. In many cases the lower portions of the trails are still open. Last year at least 39 peregrine falcon pairs nested in Vermont, producing at least 60 young falcons chicks that left the nest.
