Two years later, developer seeks state permit to expand Wal-Mart

BENNINGTON, Vt.—A developer hoping to double the size of a Bennington Wal-Mart has filed for a state land-use permit, more than two years after the town approved the project.

Jonathan Levy, of BLS Bennington, LLC, filed the Act 250 application Tuesday.

The Ohio-based developer has been granted several extensions by the Vermont Environmental Court to file the permit application since he won town approval in 2006 to increase the store to 112,000 square feet.

The local permit was appealed by the Vermont Natural Resources Council and Levy, who challenged several conditions that the town had imposed.

But hearings on the appeals were postponed until an Act 250 application was filed.
