A month before McKay, Washington state's US attorney, was named for dismissal, Attorney General Gonzales's chief deputy had tried to help him win a seat on the federal bench.

One document from the Justice Department justified McKay's dismissal by stating that he showed a "pattern of insubordination, poor judgment, and demonstration of temperament issues in seeking policy changes."
