Fernande R.V. Duffly, an immigrant from Indonesia, will learn later today whether she will make history in Massachusetts and become the first Asian-American to sit on the state’s highest court.

Governor Deval Patrick last year nominated Duffly, who is currently an Appeals Court judge, to the seventh, and last seat, on the Supreme Judicial Court.

The Globe reported today that three councilors have already decided to vote against Duffly and fourth is believed to be recusing herself because of a conflict of interest. Duffly, then, will need the approval of the four remaining councilors, the Globe reported.

The vote is set for noon today at the Governor’s Council chambers at the State House.

Duffly, 61, is a Cambridge resident.
