Decision expected today in hearings for 3 charged in 'road rage' shooting

The final decisions in the dangerousness hearings for the three men charged in connection with a car chase and shooting last week in Milton are expected this morning in Quincy District Court.

Decisions were expected Thursday after the final deliberations; however, due to time constraints, Judge Diane Moriarty postponed her ruling on whether the suspects should be considered dangerous under the Commonwealth’s “Dangerousness Statute.” If they are, they can be held for up to 90 days without bail.

Roy Jaundoo, 35, of Roslindale, Kevin Taylor, 22, of Dorchester, and Caiheem Kindell, 21, of Randolph pleaded not guilty last Friday to various charges, and were ordered held.

Wednesday and Thursday, four witnesses, all Milton police officers, recounted their role in the investigation and answered questions about the identification of the men and where they were located the night of the incident.

Norfolk Assistant District Attorney Adam Lally urged the judge to rule the men dangerous and not allow bail under any conditions in order to provide the most protection to the alleged victim and Milton residents.

However, defense lawyers argued that there was not enough evidence raised during the hearing to connect the three men to the crime and that they should not be considered dangerous. They argued their clients should be released on reasonable bail to the supervision of family and probation officers.

Ethan Yankowitz, who represents Kindell, read a series of suggestions Kindell’s mother wrote to the court including releasing him to her, requiring him to attend adult school, and twice-a-week meetings with a probation officer.

Attorney Mark Bennett additionally asked for the court to dismiss the case against Taylor entirely, stating the police did not have probable cause to arrest him in the first place.

“To say this case [against Taylor] has more holes than Swiss cheese would be a major understatement,” Bennett said.

The Milton police are continuing their investigation into the incident and are searching for a fourth suspect believed to have fled the scene. They have not reported any new information or arrests since last week.
