Peabody teen to face OUI charge in Herrick Road crash
The teenage driver whose car crashed into a Peabody home last month is scheduled to be arraigned in Peabody District Court today on five charges, including operating under the influence of alcohol and reckless operation of a motor vehicle, according to a statement released by police yesterday.
Robert Habeeb, Jr.’s car burst into flames before firefighters pulled him from his burning sedan around 2:30 a.m. on Dec. 11. The car flipped on its side and propelled the engine from the car onto the front lawn of 44 Herrick Rd., where it continued running. Habeeb was transported to Massachusetts General Hospital for treatment of injuries and later released.
The 18-year-old will also be formally charged with negligent operation of a motor vehicle, failure to stop/yield and failure to have an inspection sticker, according to Peabody police.
Last month police issued a criminal motor vehicle citation for operating a motor vehicle recklessly so as to endanger. The charges, however, did not include operating under the influence.
At the time, Habeeb’s father, Robert Habeeb, Sr. said his son fell asleep at the wheel.
“Falling asleep while you’re driving is evidently a criminal offense,” the elder Habeeb said during a telephone interview at the time. “It is what it is if it’s illegal. The fact that nobody got hurt is really what counts.
After the crash, the Peabody High student had bruises, a sore and a swollen leg, a sore back, burns on his knuckles, a bruised spleen, and throat irritated from inhaling smoke.
The owners were not home at the time of the crash, but, after assessing the scene. The estimated damage to the house was about $50,000.
Lieutenant Detective Scott Richards lead the investigation and members of the Massachusetts State Police Accident Reconstruction Team also assisted the investigation.
