New suit over Fernald center for mentally disabled

Advocates who failed to keep Massachusetts from closing a residential center for the mentally disabled say they will file a new lawsuit over conditions there.

The US Supreme Court declined this week to hear their appeal of a closing order for the Fernald Development Center.

Parents and guardians said Wednesday the state is discriminating against the residents by allowing dramatic declines in care and conditions as its works to meet a June 2010 closure deadline.

The prior case sought the court's approval to keep Fernald open for its long-time residents.

The Executive Office of Health and Human Services says the state is committed to "providing only the highest level of care" and has "fully maintained the quality of services available to residents of the Fernald Center."
